The property in The Fountains at Raintree is bound by the Covenants and the Fountains HOA Board. It is the responsibility of FARB to ensure that the traditional appearance of the neighborhood is maintained and to pre-approve any work on the exterior of your home, whether it changes the appearance or not. It is the Homeowner's responsibility to seek and receive the ARB’s approval before proceeding with any exterior changes/repairs, including painting, deck staining, garage door replacement, window replacement, new roof, concrete lawn edging, pergolas, decks, patios or extensions, etc. DO NOT WAIT UNTIL THE LAST MINUTE TO REQUEST APPROVAL. IT COULD TAKE UP TO ONE MONTH TO GET APPROVAL FROM BOTH ARBs!
Your approved project application is good for 6 months. DO NOT START WORK without all approvals in place! Potential financial penalties from both HOAs could be levied against the homeowner!
PROCESS: Fill out the RLPOA Request form. Obtain a copy of your property plat from RLPOA Don’t forget to check to see if a City building permit is required. If you are unsure, then contact a FARB member
EXTERIOR PAINTING
General Requirements
• Only approved colors may be used.
• Colors must be appropriate for the material being painted (stucco, siding, trim, garage doors, etc.).
• Color combinations must be harmonious with the home and surrounding properties.
• Trim and body colors must be coordinated.
• High-gloss finishes are not permitted.
• Bright or non-traditional colors that are not consistent with the community are not permitted.
Application Requirements
• All applications must include manufacturer color name, color number (if available), and a physical sample.
• Approved color lists are provided as a reference; applicants must still submit the specific color name, number, and sample for approval.
Approved Color Categories
• Stucco Colors (Approved List)
• Siding Colors (Approved List)
• Garage Door Colors (Approved List)
• Deck & Exterior Wood Colors (Approved List)
Deck & Exterior Wood Elements
• Decks and exterior wood elements must be stained or painted in colors compatible with the home and surrounding structures in shades of brown.
• Bright or contrasting colors are not permitted.
• Samples must be submitted for approval.
Color Matching Clarification
• Approved color samples are based on Sherwin Williams reference colors.
• Equivalent colors from other manufacturers may be used only if they closely match an approved color.
Non-Conforming Colors
• Existing non-conforming colors may remain until repainting is required.
• Colors must be brought into compliance at the time of repainting.
• Non-conforming colors may not be used as a basis for new approvals.
Important
Printed or digital color representations may vary. Final approval is based on actual samples and manufacturer specifications.
Enforcement
• The FARB reserves the right to require repainting if unapproved colors are applied at the homeowner’s expense.
HARDSCAPE/EDGING/FENCING
General Requirements

All hardscape and structural exterior improvements or modifications require prior written approval from the FARB.

All installations must be compatible with the architectural style of the home and surrounding community and must not negatively impact neighboring properties or common areas.
Patios & Driveways
-
Installation or modification of patios and driveways requires prior written approval.
-
Patios and driveways must use hard, permanent surface materials consistent with the home and community. Loose materials (e.g., gravel) are not permitted.

Patios are permitted at the rear of the home only and must be located within the original building footprint of the home.
-
Expansion or extension beyond the original footprin, including aprons or widening, is not permitted.
-
Modifications must not create drainage issues or impact neighboring properties or common areas.
-
The FARB may require submission of a plot or site plan to verify compliance.
Hardscape (General)
-
Hardscape elements must be designed and installed in a manner consistent with the architectural style of the home and surrounding community.

Materials, layout, and design will be evaluated for visual impact, durability, and compatibility.
Landscape Edging
-
Landscape edging installations require prior written approval.
-
A minimum of seventy-two (72) inches of clearance must be maintained between edging and any adjacent structure or obstruction.

Edging must allow access for maintenance equipment and mowing.
-
A Landscape Edging Waiver must be submitted with the application.
Fencing
● Fencing requires prior written approval.
● Fencing must be white aluminum and consistent with existing community fencing in style and appearance.
● Fencing is permitted on patio areas only and is not allowed in yard areas.
● Fence height may not exceed 32 inches.
● Fence posts must be spaced approximately 36 inches apart.
● Existing non-conforming fencing does not establish precedent for future approvals.
Maintenance
● All hardscape and fencing must be maintained in good condition and repair.
● Damaged or broken components must be repaired or replaced as soon as reasonably possible.
Enforcement
● Unauthorized work or non-compliant installations may result in required modification or removal at the homeowner’s expense and may be subject to fines.
Important
● All approved work is subject to final review for compliance with the approved application.
Trees/Grounds
Tree Removal & Planting (Homeowner Property Only)

Tree removal and planting on homeowner property require prior written approval.
-
Proposed trees must not be invasive, nuisance, or otherwise inappropriate for the community.
-
The Grounds Committee has final authority over all tree planting and removal decisions.
Placement & Requirements
-
Trees must comply with property boundaries and established planting areas.
-
Homeowner is responsible for all costs associated with planting, irrigation adjustments, and initial maintenance.
-
Irrigation systems, sprinkler heads, and related components affected by planting must be properly adjusted, relocated, or repaired at the homeowner’s expense.
-
Improper placement or planting may require relocation or removal at the homeowner’s expense.
-
The approved tree list is currently under development and will be added when complete.
-
In the interim, applicants must submit the proposed tree type/species for review and coordinate with the Grounds Chair for guidance and preliminary approval.

Final approval remains subject to Grounds Committee review.
Common Ground
-
No trees on common ground may be removed, trimmed, sprayed, fertilized, planted, or otherwise altered without prior written approval from the Grounds Committee Chair or designated representative.
Requirements
-
All work must be performed in a manner that protects surrounding landscaping and common areas.

Any damage to common ground, irrigation systems, or neighboring property must be repaired at the homeowner’s expense.
Enforcement
-
Unauthorized work or non-compliant installations may result in required remediation, removal, or replacement at the homeowner’s expense and may be subject to fines.
Important
-
All approved work is subject to final review for compliance with the application.
ROOFING
Materials
• Asphalt/fiberglass shingles in architectural style are required.
• Shingles must carry a minimum 40-year warranty.
Construction Requirements
• Exposed metal valleys must be brown.
• Manufacturer enhanced ridge or double-layer ridge is required.

Color Requirements
• All roof colors must be within the brown color range.
• Color selection must be from the approved manufacturer lists above.
Windows/Gutters/Drainage
Windows
· Replacement windows must match the original style and appearance of the home.
· Windows and frames must be white.
· Grids are not permitted unless original to the home.
· Windows must be vinyl-clad or equivalent approved material.
· Changes to size, shape, or configuration require prior approval.
· Windows must be maintained in good working condition.
Gutters & Downspouts
· Gutters and downspouts must be white or cream.
· Replacement or modification requires prior approval.
· Installation of gutter guards requires prior approval.
Drainage Requirements
· Drainage must not be directed onto neighboring properties or common areas.
· Drainage must not negatively impact neighboring properties or discharge into storm drainage systems improperly.
· Buried drainage systems must be designed to prevent runoff onto neighboring properties.
· Improper drainage may require correction at the homeowner’s expense.
Irrigation / Rain Sensors
· Homeowners are responsible for coordinating the removal and reinstallation of rain sensors when gutter work is performed.
· Any damage or costs associated with relocation or reinstallation are the responsibility of the homeowner.
Important
· No work may begin until written approval has been issued.
· All approved work is subject to final review for compliance with the approved application.
· Non-compliant work may require correction or removal at the homeowner’s expense.
